Why High Court acquitted DCJ Mwilu abuse if office charges,leaving DCI in shame

HON. PHILOMENA MBETE MWILU VS. DPP & 3 OTHERS (NAIROBI HIGH COURT CONSTITUTIONAL PETITION NO. 295 OF 2018

SUMMARY OF JUDGMENT

1. There was no violation of of any of Articles 27 (1) and (2), 28, 47, 50 (2) (a), (b), (c), (j) and (k) and 157 (11) with respect to decision to prosecute the Deputy Chief Justice (DCJ).

2. There was a factual and legal basis for the pressing of charges against the DCJ in Counts I and Count II.

3. Charges were not defective for the lack of a complainant as the Republic is the complainant in all criminal matters on behalf of all citizens.

4. There was no legal basis for charges brought in Counts 3, 4, 5, 6, 7, 8, 9, 11 and 12 as they related to issues of stamp duty and which the DCJ had no connection to.

5. The press statements by the DPP and the related media reports did not infringe the rights of the DCJ.

6. The decision of the DPP to press charges against the DCJ was not tainted by ulterior motives, irrationality, unreasonableness, nor illegality.

7. Judicial Immunity does not shield judicial officers from prosecution for criminal acts that are done outside their judicial office.

8. Acts of judicial officers outside their offices can be the basis of investigations and or prosecution by the Director of Criminal Investigations (DCI) and Director of Public Prosecutions (DPP) respectively.

9. While the DCI is not precluded from bringing charges against charges against judicial officers, there is a framework for dealing with matters relating to misconduct and thus such matters should at the first instance be referred to the Judicial Service Commission (JSC).

10. The charge of Abuse of Office under Count I ought to have been referred to the JSC in the first instance because the alleged actions related to the DCJ’s office.

11. The charge of Obtaining Execution of a Security by False Ptetences under Count II fell outside the DCJ’s office and could thus directly lead to prosecution without reference to the JSC.

CONCLUSION

12. The DCI illegally obtained evidence thereby infringing on the DCJ’s Right to Privacy and thus the charges have no legal foundation.

DISPOSITION

13. Evidence underpinning the prosecution was illegally obtained in a manner detrimental to the administration of justice.

14. An Order of Certiorari is issued quashing the criminal charges as against the DCJ.

15. No orders are issued as to the Interested Parties as his prayers were outside the prayers by the Petitioner.

Pastor Ng’ang’a video exposes two critical things

My dad, the late Mzee Kilai Kisingu once told me that men who get beaten by their wives do not get ass-whacking because they are weak.

Their wives throb them because they know they can.

She will start by gently asking you whether it is necessary to visit your mother every month. Then why you should pay college fees for your young sister. And why you are the only one who pays medical bills for your aged dad.

Mzee told me that the lady will just be testing the waters.

Once you say yes to the queries above, your geese is cooked. She will turn you in to putty in her hand and finally she will whack your cheeks so hard that you will be left looking like Team Tanga-Tanga or 2022 or both.

But I digress.

I stand with ‘Pasta’ James Maina Ng’ang’a.

You see, a fool has to be told at some point that his or her stupidity is irritating which is precisely what the shepherd told his sheep who religiously take money to his supermarket located along the Uhuru Highway-Haille Sellasie Avenue roundabout.

This is a man who killed a lady through dangerous driving while stone drunk. He bribed his way through the investigative and judicial systems and was let off the hook.

The clowns who throng his dens of inequity which they christen churches pretended not to know that their ‘daddy’ was a killer and instead accused the devil of attacking the man of god.

‘Pasta’ Ng’ang’a confirmed that he has no churches but kiosks.

Stop being an imp.

The reason why the likes of Kiunas, Kanyaris, Wanjirus, Musilis and Ng’ang’as live in Runda, Karen and Muthagari is because of your idiocy.

Living in posh estates does not equate to blessings.

How can you give money to a man or woman to live a life of opulence and call that blessings while you squat in the slums?

Labbish!

How, pray, should your kids study at Kyamuthengi Primary School while those of your ‘papa’ and ‘mummy’ are at Manchester High School?

Takataka!

Why should you walk to the den of arrogance owned by ‘papa’ which you call a church while the latter cruises in ten different top range cars?

Why should a man or woman who went to school herd his family to a conman house to be ‘blessed’ by an ex-convict?

Stupit!

If you want to be blessed, help the poor especially widows and orphans. Go to your village and identify one needy case and make sure that they either never sleep hungry or skip classes due to lack of school fees.

Your life will never be the same again.

For crying out loud, stop using your heads like military boots. Sieve sense from the nonsense. There should be a huge difference between you and a hedgehog in matters thinking.

Hedgehog is ‘kìthangaitì’.

Police hunt for a man who killed girlfriend in Australia

Very very distressing news from Perth, Australia.

The lady in the picture is called Nancy. She traveled to Australia for studies and also got herself a boyfriend (pictured).

5 days ago she was to travel from Australia to USA but she didn’t make it. A friend raised alarm after she missed the flight and she was reported missing.

Her body has been found today in her house. She was murdered.

The above boyfriend sneaked from Australia to Kenya 3 days ago. Australia Federal Police are looking for him as the chief suspect.

She leaves behind children who are with her mum here in Kenya.

Sonko waivers parking fees for Muslims at Jamia mosque

Nairobi Governor, Mike Mbuvi Sonko has waivered parking fees at Jamia mosque on all Fridays to allow worshipers access the mosque with ease.

The governor made this revelation during the Iftar prayers at Jamia mosque which was also attended by President Uhuru Kenyatta, Cabinet Secretaries Najib Balala (Tourism), Eugene Wamalwa (Devolution and Regional Development) and Yemeni prime minister Moin Abdulmalik among other leaders.

Sonko added that bars located near mosques would also be forced to reduce their noise in respect of prayers at the mosque.

He also made a promise to the muslims stating that his administration would purchase additional land to be used as a cemetery for them.

Sonko cited that the county government had identified a piece of land beside the Lang’ata cemetery that could be used as a cemetery by the Muslims.

“We have got land beside the Lang’ata cemetery but we will have to wait for the National Land Commission to be reconstituted so that they can guide us on the buying process,” he stated.

On his part, President Kenyatta told the worshipers that as the president, he would continue declaring both Eid-Ul-Fitri and Eid-Ul-Adha as public holidays but the ultimate decision to include them in the constitution would be made later.

“I have heard your request including Eid as a public holiday. I wish I had such powers. That will be considered when we decide what we want to change in the constitution.

Breaking: Reprieve for DCJ Mwilu as court rules no charges for abuse of office

A five judge bench has ruled that the deputy chief justice will not be charged with abuse of office.
Justices Hellen Omondi, William Musyoka, Mumbi Ngugi, Chacha Mwita and Francis Tuiyot said the DCJ can be undertaken through a criminal proceedings after completion of investigations by the relevant bodies.
The Judges further said that the DCJ is not immune from criminal prosecution under the Kenyan law.
The jury added that the office of the DPP acquired information about Mwilu’s bank accounts illegaly.

He will take over the morning show as the lead presenter and will also be the overall deputy program controller.

Mr Sang is one of the living most successful radio presenters in the league of Maina Kageni, Cess Mutungi and Vincent Ateya. He was head of Radio at KASS FM before he was wrongly accused of fueling ethinic tension in 2007. Later Hon Moses Kuria confessed that he together with the then Justice and Constitutional affairs minister Martha Karua were instrumental in fixing the bad ass journalist. Sang was acquitted together with deputy president William Ruto for lack of evidence.

In 2017 Mr Sang a close ally of DP Dr William Ruto vied for Trans-zoia senate seat but lost narrowly. Millions of EMO FM that has a huge following in Rift Valley are excited to have Sang roar in the airwaves. With Sang behind the Mic on morning show, Kass FM is facing a threat since Joshua has a critical mass behind him.

African Union envoy on infrastructure Raila Odinga has bashed out Kiambu Governor Ferdinand Waititu in a question of permission to joining Kenyans in Kiambu.
Odinga who launched the Tatu City housing project said its a fruit of handshake between him and president Kenyatta.
Odinga said that the project will help ease the cost of living for Kenyans and enhance agenda 4 by the government which included housing.
Raila further reiterated his statement on the war against graft, impunity, creating jobs and promoting unity.
Waititu has openly declared to be a Tanga Tanga member , a wing that is led by the deputy president William Ruto.
Waititu has been in the limelight after his arrest due to abuse of office and embezzling funds meant for the people of Kiambu.
EACC confirmed that Three companies owned by Kiambu Governor Ferdinand Waititu, his wife Susan Wangari and their daughter Monica Njeri allegedly received kickbacks worth millions of shillings for irregularly awarded road tenders worth Sh588 million.

The details are contained in an affidavit by Ethics and Anti-Corruption Commission (EACC) detective Regina Ng’ang’a, which was Thursday filed before Kiambu principal magistrate Brian Khaemba, in response to an anticipatory bail issued last week.
The county boss has been in the spotlight over acquisition of multimillion-shilling properties in Nairobi’s central business district, notably Delta Hotel and Jamii Bora House, Runda and Migaa, with his critics saying he has acquired them using stolen county money.

Raila arrives from Ethopia, holds talk with Kalonzo at JKIA vip room

Orange Democratic Movement party leader Raila Odinga on Friday arrived from Ethiopia where he had gone for a two-day infrastructural development conference.

The African Union High Representative for Infrastructural Development has been pushing for expansion of infrastructure among member countries since he was appointed in October 2017.

While in Ethiopia, he advocated for expanded trade within Africa, the introduction of high-speed rails and broadband connectivity.

On Friday, Raila held talks with former Vice President Kalonzo Musyoka at Jomo Kenyatta International Airport, VIP section. Details of their meeting were, however, not disclosed.

Kalonzo deputised Raila both in 2013 and 2017 polls. The two have been working closely despite hiccups after the hotly contested 2017 polls.

Raila reconciled with President Uhuru Kenyatta without Kalonzo’s knowledge. Last year, Uhuru appointed the Wiper party leader to IGAD, where he will be the peace ambassador to Sudan.

While Kalonzo has made it clear that he will contest for presidency in 2022, Raila is yet to declare, even though a number of his allies have often linked him to the race.

Anxiety for DCJ Mwilu as 5 judge bench determines her future on Friday afternoon

Deputy Chief Justice Philomena Mwilu is expected to appear before a five-judge bench on Friday.

Justices Hellen Omondi, William Musyoka, Mumbi Ngugi, Chacha Mwita and Francis Tuiyot will determine if she will be put on trial or not.

The verdict is on whether the allegations drawn against the DCJ are criminal-based and whether she is immune from criminal prosecution under the Kenyan law.

Mwilu, who had earlier obtained court orders stopping her prosecution, filed a petition asking the court to drop the charges levelled against her by the Director of Public Prosecution.

According to her, investigators lacked solid evidence and the DPP has no legal powers to prosecute the holder of the DCJ office.

She also faulted the DPP’s move to prosecute her as ill fated and politically instigated.

The DPP through British prosecutor Council Khawar Qureshi however called upon the judges to drop the petition filed by the DCJ.

He insisted that they have substantial evidence to indict her on criminal charges and not civil charges as she claims.

“The DPP followed the law in preferring charges against DCJ on failure to pay stamp duty and abuse of office,” DPP argued.

If the verdict goes against the DCJ Friday afternoon, she will be the first Supreme court judge to be charged at a lower court.

The DCJ is on the spot over alleged abuse of office, fraud and bribery related charges.

DCJ and DPP might apply for a stay with an intention of moving to the court of appeal to challenge the high court decision.

K24 anchor Serah Teshna quits after one year in the Uhuru owned station

K24 TV presenter, Serah Teshna has announced her departure from the station after working there for one and a half years.

Teshna, who was the ‘K24 Alfajiri’ show presenter thanked her directors, producers and the media max fraternity who entrusted her to do the show in November 13, 2017.

“When I started I was very fresh, very green but you guys just trusted in me and held my hand,” Teshna stated.

Teshna stated that she would reveal her next career path in the next two weeks.

Though Teshna did not reveal where she was heading to, sources from the station revealed that she was wanted to concentrate more on acting.

The 29-year-old has won numerous awards as an outstanding actress including Best Lead Actress in 2011 and 2012 during the Kalasha Film Awards.

Teshan hosted K24 Alfajiri alongside Ciru Muriuki and Jeff Mote having previously hosted the Screen Therapy show host on KTN.

Out of the initial K24 Alfajiri crew, Mote is now the only remaining host after Ciru Muriuki quit the station in July.

In December 2018, the presenter was rumored to be heading to Citizen TV’s Daybreak show after Joey Muthengi quit. However, that did not come to pass.

Video: Pastor Nganga lashes out congregants , calls them stupid over disrespect to his wife

Neno Evangelism Pastor James Ng’ang’a has unleashed a rant on his bishops accusing them of disrespect.

In a six-minute video, which has surfaced online, the seemingly irritated pastor slams his bishops for disrespecting his wife.

The controversial pastor went ahead to hurl insults at the bishops as his congregations kept mum.

He accuses the men and women, who have amassed wealth while in his church, of arrogance.

“Nataka kuongea na mabishop wale wako kwa kanisa langu, if you’re not going to respect my wife am going to kick you out of my ministry, even if who you are, ata kama tulitahiriwa na wewe.

“Wajikanga hawa…mmenikuta kwa hii ministry na wake wenu hawa. Mmetajirikia hapa hapa kwangu, stupid arrogant. Mmenikuta hapa hapa nikihubiri na mkokoteni mkatajirikia hapa. Nimesema kama hamtaheshimu mke wangu am not going to serve with you, kama mke wako hataheshimu mke wangu na mmekuja kwangu na matuta … useless people taka taka , rubbish, hakuna kitu mnaezaniambia mimi watu wa Neno, mimi ndo neno” Ng’ang’a says.

Ng’ang’a goes ahead to say the devil is behind his recent tribulations, and that the media has focused on bringing him down because he’s the founder of the church.

“Am facing all this bad because of Neno, Satan wants to bring Neno down that’s why the devil is fighting me all over media, alafu wewe na mke wako mnadhani mtanitahirisha,” he adds.

He vows that if the trend continues, he’ll close all Neno branches across the country, but his.

Ng’ang’a is not strange to controversy. He was recently arrested and charged with threatening to kill Citizen TV journalist Linus Kaikai in a video.

Kaikai, the Director, Strategy & Innovation at Royal Media Services, filed a complaint with police over the “consequences” threat from Ng’ang’a over his stance on ‘con’ pastors in Kenya.

He was also arrested for conning a businessman Ksh3.6 million.77

4 arrested in robbery with violence case, pistol found in Nyeri

Police have arrested four robbery suspects and recovered a pistol loaded with one bullet at Majengo slums in Nyeri Town.

Two other suspects are said to have escaped as police recovered an assortment of stolen household items.

The suspects are believed to be part of a burglary gang that has been terrorising residents of Nyeri suburbs in the past weeks.

According to police, the Tokarev pistol that was recovered was hidden inside the house of one of the gang members and was discovered accidentally by a female companion who had visited him.

She is said to have spotted the gun hidden in a suitcase and tried to run away when the gang members attacked her fearing she would sell them out.
The woman, who was injured by the suspects, was taken to hospital for treatment of the injuries inflicted on her by the gang.

Mr Nyange said that the gang members were recently released from Nyeri Medium Prison, King’ong’o and re-joined the world of crime.

“They were recently released and now are turning Majengo slums into a hideout,” Mr Nyange said.
The recovered weapon, according to the police, has been linked to a series of robberies that have been reported in recent weeks around Nyeri.

Police have now warned the lawbreakers, saying they will clean Majengo slums that have a history of providing homage to some of the country’s most wanted criminals.

“I want to put these criminals on notice. They may have not known who is in charge but the commander is back. And this time we are bad,” Mr Nyange said.

The police boss was recently transferred to Nyeri from Kiambu County. He previously served as the Nyeri Central Divisional Police Commander.

Nyeri residents who recently reported being robbed have been asked to report to the Nyeri Central Police Station to identify their stolen property from among the recovered items.

Former Independent Electoral and Boundaries Commission (IEBC) commissioner Roselyn Akombe was among thousands of Kenyans who watched Miguna Miguna’s interview on Jeff Koinange Live.

In a tweet after the Wednesday night programme, Akombe reacted to the tell-all interview.

Dr Akombe described the prime time interview as powerful, saying that it offered food for thought as the country grappled with a lot of issues.

The former IEBC commissioner hinted at making an appearance on the show by asking the show’s host Jeff Koinange to bring the bench to New York where she is based.

“Quite a powerful #JKLive interview by @MigunaMiguna. Food for thought as we grapple with #StateCapture #competencybasedcurriculum #BeggingSafaris to name but a few. Welcome to the NYC benches @KoinangeJeff next time!” her tweet read.

Renowned lawyer Miguna Miguna appeared on the show Wednesday night in which he recounted the brutal treatment he was subjected to in the lead-up to his deportation.

He also recounted the intrigues of Raila Odinga’s mock inauguration in which he played a prominent role and led to his deportation in 2018.

Miguna maintained that the immigration officials acted in violation of the law by deporting him.

The show was shot on location in Washington DC, the capital city of the United States of America.

It turns out DP Ruto was a son of a large scale farmer, his neighbour Mzee Jackson Kibor has revealed that DP Ruto’s father was a large scale farmer who supplied thousands of maize to the state strategic grain reserve the National Cereals and Produce Board and also supplied hundrends of litres of milk to KCC daily.

Ruto’s family had tractors and grade cows in 1970s, his father a native of Belgut constituency in Kericho county ventured into Uasin Gishu to practice large scale farming. Ruto was not a hustler, selling chicken was just a pass time for most Nandi young boys who were allowed to rear chicken as parents never value birds, rearing chicken was left to young boys and mothers (women) as a hobby and not for economic value back in the 1970s and 80s- Mzee Kibor told local reporters

Meanwhile Hon Moses Kuria says: As a son of a peasant I will not use my humble background as a tool to ascend to power, just the same way I do not expect those from rich backgrounds to use their privileged backgrounds as a tool to ascend or keep power. Hubris is unacceptable from those of us from poor backgrounds as it is from the rich. Humility needs to be our guiding factor for both chicken sellers and sons of Presidents.

I skipped prayer breakfast because of insincerity in our leadership : Senator Kajwang

President Uhuru Kenyatta on Thursday led several leaders to a National Prayer Breakfast at Safari Park Hotel.
However, some leaders skipped the event which is normally held annually. This was the 17th event.
ODM leader Raila Odinga is also among the leaders who skipped the event alongside his allies.

Senate’s Senate County Public Accounts and Investments Committee Chairman, Moses Kajwang’, has accused some of the leaders who attended the prayer breakfast of insincerity.

Mr Kajwang’ (Homa Bay) said on Thursday that the leaders used the event to “wash their sins” of corruption.

“Some leaders are using the prayer meeting to show themselves as God-fearing but at the back of their minds, they know that isn’t true,” he said.

Speaking at Alero beach in Suba North, the senator expressed concern that Kenya will run into more debt if the vice is not dealt with.

“Kenya is almost bankrupt because of debts. Some of the problems the country is facing [were brought on] by corrupt leaders,” he said.

Mr Kajwang’ said he skipped the event because of the “rampant corruption” in the country. He added that until graft cases are reduced or completely neutralised, he will skip all meetings of this nature.

Leaders including President Kenyatta attend the meeting annually to pray for the country.

The war inside Jubilee party took a center stage yesterday when president Uhuru Kenyatta engaged in war of words with his deputy William Ruto.
This started when Ruto asked if he could send Raila’s curriculum vitae for prime minister position in the United kingdom following the resignation of Theresa May in a weeks time.
Ruto further told the president indirectly that he was not having shoes in 1981 when Uhuru had but now they were sitting on the same table.


On his part President Kenyatta urged leaders to stop politicking and instead act on the promises and commitments made to the people of Kenya.
Uhuru added that the only way to build a better nation that is all inclusive is by walking the talk for the benefit of all Kenyans.

Dam scandal hits back as KVDA sacks DP Ruto ally MD David Kimosop

The Board of Directors of the Kerio Valley Development Authority (KVDA) has now fired David Kimosop as Managing Director of the authority.

The board, in a statement to the press Thursday evening, appointed Francis Kipkech to take over the mantle in an interim position until a new MD is selected.

Mr. Kipkech was, until his new appointment, serving as Mr. Kimosop’s deputy Managing Director.

“The Board wishes to assure the public and other stake holders that the services. Programmes, and projects of the authority will continue uninterrupted,” read the statement.

“The Board wishes to appreciate Mr. Kimosop for the service rendered to the authority and the stewardship of the entity towards the successful achievement of its programmes and interventions”

The embattled outgoing MD Kimosop was previously summoned by the Director of Criminal Investigations (DCI) over the Arror and Kimwarer dams scandal in which the country allegedly lost Ksh.21 billion.

William Ruto is overstretching his hustler narrative, he is actually mocking the millions who grew up in extreme poverty. Did you know that DP Ruto has never slept hungry in his lifetime? Did you know that the worst meal DP ever had in his childhood was Milk and Ugali? did you know that DP Ruto’s father migrated from Belgut, Kericho county to Uasin Gishu county where he ventured into large scale farming long before young Ruto was born? did you know that Ruto’s family were the elites of their sub location?. His father was a large scale farmer who specialized on Maize, Wheat and dairy farming? yes they had grade cows in 1970s and his father delivered thousands of Maize bags to NCPB, delivered hundreds of litres of Milk to KCC.

Well, DP Ruto was lucky to be born a son of a large scale farmer in the expansive Uasin Gishu and BUT can you compare his background with that vice president Kalonzo Musyoka? Ruto has never slept hungry! They had tractors and grade cows in 1970s; is that poverty? useless !

Former Vice President Kalonzo Musyoka grew up in an extreme poverty background, raised in a polygamous family in the desert, rocky, dusty county of Kitui that is full of witchcraft but he has never used his background to try and get into political office. Governor Kivutha Kibwana too grew up poor but he ended up at Harvard Law School and became a professor at the university of Nairobi. Chief Justice Willy Mutunga too grew in poverty but he did not use it to blackmail Kenyans to elect him. Raphael Tuju’s mother was a house maid at Mzee Nyachae’s home but you have never heard Tuju cry demanding to elected for being a son of a Mbochi

Governor Mike Sonko even served jail term but he has not used it to blackmail Kenyans into electing him, he is instead focused on the poor while DP Ruto is alleged to have cartels in critical sectors looting from the poor to enrich himself, infact he is accused of using some poor Kalenjin professionals to loot State corporation and most of the said professionals are now facing jail as EACC/DCI and DPP close in on them.

How many poor people has DP Ruto held hands to help them grow? instead we even heard that he impregnated a poor university student Mama Abby only to ruin up her life todate, there could be many more such cases, you never know. The damage he has done to the poor through his alleged cartel network since 1992 YK92 sorjourn is staggering. Somebody tell Ruto to just swallow his head and spare Kenyans hypocrisy, we shall not entertain to be mocked. #CURSED!

There are no known pictures of DP Ruto doing odd jobs in the village during his childhood, if he ever sold Chicken that was a typical boy thing and the money he made was just for himself. How many Kenyans of his age who grew up in Northern Kenya a desert and had no such luxury of three meals a day and could venture into chicken farming?

Ladies and gentlemen,

This morning, as has become tradition, the Country observed a day of reflection and prayer at this year’s National Prayer breakfast under the theme “A new dawn”. Kenyans no doubt remember last year’s prayer breakfast at which the leaders of the nation including President Uhuru Kenyatta, H.E Raila Odinga, Hon Kalonzo Musyoka and DP William Ruto, agreed to bury the hatchet and work together to promote peace, unity and tranquility across the country. They all supposedly united in a sincere gesture to bury the culture of divisive politics and chart a new path for our country. Apologies were tendered for the vitriolic and hurtful things that were said during the 2017 Election Campaigns. People hugged.

A year later, questions abound about the genuineness of this annual spectacle and the sincerity of our leaders – the smiles and hugs and niceties given that non-other than DP Ruto has dragged us back to the politics of intrigues, personalized attacks and insults sustaining a petty, juvenile and ill-informed political onslaught on Rt Hon Odinga. Even the solemn occasion of prayer for the nation’s many problems for him was but another platform to take another swipe at Hon. Odinga.

There are many more problems this country has that cry for solution. Among them corruption, land grabbing, political blackmail and constant threats of violence, all of which the DP’s imprimatur is almost always present. That the DP even gets to speak at these prayer breakfasts turns the event into a spectacle of hypocrisy.

Our young people require jobs, even as the DP obsesses with “offering” the Rt Hon Odinga jobs at every turn. This is laughable though because we all know who has capacity to find employment for the other. Kenyans know that it is Raila Odinga who gave Ruto a job as a minister in the grand coalition government, a job from which he was sacked due to rampant corruption.

It is also not lost on us that Jubilee promised Kenyan Youth a million jobs a year and that this promise, just like the stadiums, remain a mirage. In fact given his apparent enthusiasm for finding people jobs for H.E Raila, jobs Raila has neither asked for nor needs Ruto’s help to get, we shall soon be calling all the unemployed youth in this country to bring their CVS and march to the DPs office and dump them there so he can find them jobs, as that should be his focus.

We wish to make it clear that we are not prepared for empty sloganeering and promises of unity that do not translate to tangible results among the people. The day’s theme, ironic as it now looks, was building upon the events of last year when our leaders famously shook hands and whereas the President appears focused on the big 4 and the unity agreed upon during the handshake, his deputy consistently attempts to derail the country and take us back.

The DP should focus on salvaging his dwindling political fortunes, seeing as the country has read through his political blackmail and will no longer take his lies.

DP William Ruto went to school without shoes his first shoes was in 1981worth 60ksh but today he is sitting in high table stealing from those without shoes.

Well, back in 1980s the poor never died of hunger, we had plenty to eat from our farms, school was free right from nursery to university education, in fact university students were paid to study and campus dining halls cook five star hotel food.

There is absolutely no credit to DP Ruto saying he was poor, 99.9% of Kenyans are poor, we cannot all be deputy president so his speech was meant to mock the poor and also mock Uhuru Kenyatta the son of the founding looter Mzee Jomo Kenyatta whom Ruto is emulating.

Ruto concluded by mocking Kenyans and particularly Uhuru Kenyatta by saying that he (DP Ruto) had more to thank God for than Uhuru the son of a rich big man and also that his prayers were more worth than those who were poor and still struggling, this man is crazy. May be he should pray to regain some weight, stop losing hair and also cool his petty anger against the second liberation hero Raila Odinga who was jailed and tortured for 9 years without shoes, proper food, no sleep etc…

South Sudan President Salva Kiir on Thursday visited former President Daniel Arap Moi at his Kabarak home.

President Kiir, who was received by Senator Gideon Moi, held talks with the former president for almost one hour.

They discussed peace initiatives in the country with President Kiir appreciating Mzee Moi’s effort towards sustainable peace and stability of South Sudan and the greater horn of Africa.

He was accompanied by his Foreign minister Nhial Deng Nhial, Director General External Security Gen. Thomas Doath, Republic of South Sudan Ambassador to Kenya Chol Mawut and the Executive Director Rizig Dominic.


Kenya’s Cabinet Secretary for Mining and Petroleum Peter Munyes was also present.

Earlier, President Kiir joined President Uhuru Kenyatta and other leaders for the prayer breakfast at Safari Park Hotel in Nairobi.

Police arrests 3 suspects with Bhang and Heroin in Lamu county

Police in Lamu have arrested three suspects who were found with bhang and heroin estimated to be worth about Sh22,400.

Confirming the incident on Thursday, Lamu County Police Commander Muchangi Kioi said the first two suspects were arrested while ferrying 25 rolls of bhang in a vehicle from Mtangawanda to Kizingitini in Lamu East on Wednesday evening.

The third suspect was arrested while ferrying 18 rolls of bhang and 18 sachets of heroin in a boat within Lamu Island.

The vehicle and the boat used to carry the narcotics were also impounded.

Mr Kioi said the three suspects are in police custody but will be arraigned any time.

“We received a tip off from members of the public at Mtangawanda Jetty that a vehicle was ferrying narcotics to Kizingitini. My officers immediately swung into action by laying an ambush along the Mtangawanda-Kizingitini road. After a thorough search of the vehicle, we recovered 25 rolls of bhang.

We immediately arrested the two suspects who were ferrying the narcotics and also confiscated the vehicle which is currently at the Kizingitini Police Station,” said Mr Kioi.

He acknowledged that drug peddling remains one of the major challenges for police officers in the region but was quick to say that a massive crackdown is already ongoing in various parts of the county. He called on members of the public to cooperate by giving information which will aid in arresting those involved in the illegal business.

The county police boss also gave a list of notorious drug dens in the county which are currently under police radar.
They include Mtangawanda, Tchundwa and Kizingitini on Pate Island, all in Lamu East Sub-County.
Other drug hotspots include Milano, Kashmir, Gadeni and Wiyoni areas in Lamu Island in Lamu West Sub-County.

Mr Kioi termed all the areas as “problematic” in drug peddling and said the number of police officers mandated with hunting down drug barons and even closing up the existing drug dens has been increased.

Police reports indicate that most drugs finding their way into Lamu are actually ferried in by vehicles and boats from other counties.

Mr Kioi said boat operators who take part in the drug trade will be banned from operating in the region and denied licenses.

Bomet Governor Joyce Laboso hospitalized in the U.K

Bomet Governor Joyce Labosso has sought out for treatment in the United Kingdom.

Quoting her director of communication, Bomet Governor Joyce Laboso had been ailing for a while and has decided to take a one-month medical leave for the treatment.

Her team, however, failed to disclose the nature of her disease.

The deputy governor, Hillary Bachok, is expected to take over operations for the duration she will be away.

“During her four-week absence, Deputy Governor Hillary Bachok will hold brief for her. He will be assisted by the county secretary Evalyn Rono and the chief of staff Jayne Sigilai,” read part of a statement issued by her director of communication Ezra Kirui.

Her last public appearance was on May 3 at Tembwo in Sotik.

This comes roughly months after Kisumu Governor Anyang’ Nyong’o was rushed to hospital after falling sick during the installation ceremony of Reverend Philip Anyolo.

On January 12, Nyong’o was admitted at the Intensive Care Unit (ICU) of Aga Khan Hospital.

Speaking to journalists at the time, the hospital’s Medical Director Dr Sam Oula said the governor was feeling dizzy when he arrived at the facility, adding that they administered the necessary medication.

He was later airlifted to Nairobi for specialised treatment after it was established that he was suffering from low blood pressure.
Labosso has been away for three weeks.

Opposition activist Miguna Miguna has maintained that his push to better the Kenyan political scene remains intact despite his woes.

Speaking on Wednesday during Citizen TV’s JKL show, the lawyer said that the nation is still not liberated, judging by the actions in the political scene.

He said that Kenya needs independence, hence his push and efforts by his supporters whom he termed as freedom fighters, adding that they are using legal ways to achieve their objective.

Miguna said that his is a peaceful push to restore sanity in the country, and should not be seen as a danger to the nation’s peace and stability, terming words as his main weapon.

“Kenya is not liberated; Kenya got a flag and a national anthem, ornaments but real independence is not there. Mine was an army of freedom fighters; we fight using words, you do not have to use guns,” he said.

Regarding his participation in opposition chief Raila Odinga’s mock inauguration in January 30, 2018, the vocal lawyer noted that he does not regret commissioning the oath.

“Swearing-in Raila Odinga was the right thing to and still is the right thing to do. We had a fraudulent election on August 8, 2017, and that is indisputable; it is a fact because the Supreme Court found it to be so.

“I did not swear-in Raila Odinga out of spite, I was doing it for electoral justice. You give legitimacy to a real winner,” he said.

Deputy President William Ruto has given the strongest indication yet that he will continue to donate money to the church despite critics claiming that politicians use the clergy to sanitise proceeds of corruption.

Speaking on Thursday during the National Prayer Breakfast at Safari Park Hotel, Nairobi, the DP said people should stop judging him harshly.

“When you see some of us go to church, lift hands, make this contribution it’s because we can’t forget where God brought us from Some of us have more to thank God for, than some of us,” he said.

His statement comes a day after the Director of Public Prosecutions urged the clergy to reject ‘questionable’ donations from politicians.

President Kenyatta’s name was recently drawn into the Dubai gold saga which saw Jubilee leaders rush to his defence and pass the buck to Orange Democratic Leader Raila Odinga who had also been adversely mentioned.

On Thursday, DP Ruto further said as the fight against graft hots up, there should be assurance that Kenyans are not discouraged from taking up top positions in fear of victimisation.

“As we pursue this noble course, we must remember to inspire the hawker to own a kiosk and kiosk owner to own a shop and shop owner to own a mini market,” he said.

Controversial lawyer Miguna Miguna once again proved his ‘I don’t care’ nature after launching a scathing attack at Citizen’s News anchor Jeff Koinange on his own show.

Miguna reminded Jeff how he filmed him during his deportation in January after he took part in the controversial swearing in of ODM Leader Raila Odinga.

Miguna accused Jeff of working for the government after he found him on the plane that deported him from the country. It all started when Jeff requested for a commercial break before the interview proceeds to the next session.

“We gonna take a break, come back and talk about the second one, which I filmed on the plane, you remember that one?” Jeff asked.

“When you were acting for the state…” Miguna responded

As if the attack was not enough, Miguna also faulted Citizen for allegedly editing his interview. He claimed that some parts of the interview were missing.

He, however, said that he was thankful for the opportunity he got to address critical issues in government.

During the interview, Miguna recalled the events behind the swearing in of Raila. He claimed that the ODM Leader, who doubles as AU special envoy, was not ready for the event.

Senator Wetangula must answer questions with DCI : DPP Haji

The Director of Public Prosecutions (DPP) Noordin Haji confirmed Wednesday that embattled Bungoma Senator Moses Wetangula has a date with the Directorate of Criminal Investigations (DCI).
Speaking to members of the press after a closed-door meeting with religious leaders, the DPP said that Wetangula had already been summoned and would appear before the DCI to respond to questions.

This in spite of the Bungoma Senator feigning ignorance of being, summoned to present himself to the DCI.

“I think on the fake gold, it’s clear Honourable Wetangula who has a date with you… with the DCI, ” DPP Haji said.

The summon had been issued while the former Senate Minority Leader was out of the country attending an anti-corruption conference in Hong Kong.

When he addressed the media Wednesday morning for the first time after jetting back to the country, Senator Wetangula refused to weigh in on the fake gold saga only calling it a non-issue.

The name of the senator trended for days on end after a phone recording allegedly of him and a representative of the Dubai royal family was made public.

Sleuths from the DCI made scores of arrests of suspects and arraigned them in court.

Investigations into the scam are ongoing.

Chelsea FC thrash Arsenal 4-1 to win Europa league title at Baku

Chelsea have saved the life of their coach Maurizio Sarri by securing a nice 4-1 victory over Arsenal at Baku Stadium.

After a miserable first-half, Chelsea turned on the style after the break.

The Blues scored three goals within 16 second-half minutes through Olivier Giroud, Pedro and Eden Hazard.

Arsenal did pull one back through Alex Iwobi’s brilliant strike but Hazard scored another to clinch the trophy.

Chances were few and far between in the opening 45 minutes.

Arsenal had a penalty shout turned down when Alexandre Lacazette went down under the challenge of Kepa Arrizabalaga.

The best chance of the first-half came when Olivier Giroud forced Petr Cech into a fine save.

But it was the former Arsenal striker that opened the scoring just minutes after half-time.

Giroud met Emerson’s low cross with a terrific header past Cech.

On the hour mark, Chelsea doubled their lead.

Ainsley Maitland-Niles lost possession and, seconds later, Hazard fed Pedro who finished cooly into the bottom corner.

Five minutes later, it was well and truly game over. Maitland-Niles clumsily fouled Giroud in the penalty area and Hazard sent Cech the wrong way to make it 3-0.

But the goal of the game came from Arsenal’s Iwobi.

Just minutes after he had come on, Iwobi scored a terrific half volley to give his side a bit of hope. But Giroud and Hazard combined well to allow the Belgian to score his second and put the final beyond any doubt.

The victory represents Maurizio Sarri’s first ever trophy as a manager and could well see him remain in the job for next season.

As for Arsenal, they will have to settle for Europa League football once again next season.

CS Matiangi tames betting firms, to pay 30 million per year for licensing

MPs are wagering to see if they can dissuade Kenyans from joining the betting craze with a proposed law introducing tough tax measures and minimum bets to regulate the industry.

The Gaming Bill 2019, which was published on Tuesday, sets hefty licensing fees for companies seeking to set up base in Kenya and raises the minimum amount of a bet.

For the first time, betting firms in the country will be required to pay Sh100 million for gaming securities, to serve as a cushion to gamblers should the betting firms refuse to pay a ‘windfall’.

This is in addition to an annual licence fee of Sh30 million.

Currently, firms operating public gaming (casinos) pay a Sh1 million application fee, Sh3 million licence fee, Sh500,000 annual licence and Sh25,000 for licence renewal.

In a new strategy to reduce the number of young gamblers, the Bill proposes that the minimum bet is Sh50. Currently, one can bet with Sh1 through some betting firms such as betPawa.

Royal Media’s Shabiki allows gamblers to spend Sh20, with a possibility of winning a Sh20 million jackpot.

However, at least Sh100 is required to place a jackpot bet with SportPesa.

The Bill, due to be tabled when Parliament reconvenes next week, will further restrict Kenyans’ access to foreign gaming sites.

The move is also meant to retain cash within the Kenyan economy, instead of giving it away to foreign firms.

Gaming operators are currently required to pay 35 per cent corporate tax and contribute 20 per cent of all revenue to a worthy cause.

Operators are supposed to withhold 20 per cent of players’ winnings as part of the taxation policy.

The Bill, which is due for its First Reading, proposes the establishment of The National Gambling Authority, The National Lottery Trust Fund and the Gaming Appeals Tribunal.

The government has suffered setbacks on a number of occasions as it has attempted to introduce stringent measures to control gambling, especially among the youths.

On Tuesday, the High Court declared unconstitutional a proposal by the government to ban outdoor, electronic and online advertising of gambling and betting.

Chelsea star Pedro Rodriguez targets trophy as a reward for hard work in Europa finals

It is not uncommon for Pedro to be contesting for end-of-season silverware in a glittering career in which the Spaniard has won 20 major honours. Now the Europa League final represents an opportunity for Chelsea to add a trophy to a productive 2018/19 campaign.

The 31-year-old has featured in all but one game on the way to this evening’s final against Arsenal in Baku and he has urged his team-mates to finish the season with one last push for glory against our old London rivals. The Europa League is one rare piece of silverware missing from Pedro’s CV and that fact gives motivation to the winger in a final he believes will be an open contest between two of the top five in English football.

Stop taking dirty money from politicians, DPP Haji tells the clergy

The Director of Public Prosecution (DPP) Noordin Haji has urged church leaders to reject ‘questionable’ donations as it encourages corruption.

According to him, officers are allegedly stealing money to finance campaigns for the next elections and for their own personal use.


Religious leaders from different denominations said they would support government efforts in fighting corruption.

The forum also discussed strategies that the office of the DPP has put in place to fight the vice.

On May 1 this year, Anglican Church of Kenya (ACK) archbishop Jackson ole Sapit cautioned churches against being used to ‘clean proceeds of corruption’.

“Let us not allow Harambee money to become an indirect way of sanitising corrupt leaders,” said Sapit.

Deputy President William Ruto later responded saying they are Christians first and ‘other titles after’.

His message on Twitter seemed to fuel the contention over church fundraisers that are popular with Kenyan politicians.

“Since Sunday school we learned to kneel before and worship GOD that’s the ONLY reason we stand before men. We will continue to worship JEHOVAH with our hearts and substance. We are unashamed of our God & unapologetic of our faith. We are Christians first other title after,” he said.

Stop the continued killings in the country, Uhuru warns security agencies

President Uhuru Kenyatta has broken the silence on the brutal killings which have rocked different parts of the country.

President Kenyatta has asked law enforcement authorities to stop the rising cases of killings being witnessed in the country. The President said the rising cases of mysterious killings involving innocent Kenyans across the country are alarming.

The President gave the directive when he sent a message of condolence and comfort to the family of Uasin Gishu County Governor Jackson Mandago, whose brother was found dead in an unfinished house in Eldoret recently.

President Kenyatta said rogue elements cannot be allowed to continue violating innocent Kenyans. He said the recent wave of killings in Matungu and in other parts of the country are regrettable and asked the police to bring the perpetrators of those acts to book.

The interior Cabinet Secretary Fred Matiang’i visited the region deploying G.S.U to restore order.

Following his directive several political leaders were arrested who include Kakamega Senator Cleophas Malala, ex-sport CS Rashid Echesa, MP Justus Murunga and MCA Mayoni ward Libinus Oduory.

This order applies to other regions including Marsabit which has been rocked by tribal clashes between Gabbra and Borana.
