Supreme Court Judge Njoki Ndung’u is at the centre of an ongoing attempt to defraud Mombasa Governor ALi Hassan Joho of a prime piece of land along Ngong Road.
This is the second multi-million fraud case involving a supreme court judge.
Governor Joho and his brother, businessman Abu Joho bought the land from Telkom Kenya at sh9 billion. Soon after paying the last tranche of sh2 billion, a Mr. Mburu, through his company Exclusive Estates, claimed the land belongs to him. He went ahead to put a caveat on the land.
However, this caveat was removed by the High Court, which found that he did not own the land. However, Mburu, alleged to have been a ‘sponsor’ of Njoki Ndung’u during her university days (rumours had it that he paid Ndung’u third year fees) at the University of Nairobi’s school of law,appealed the case and started using her to pile pressure on judges of the appellate court.
Joho’s lawyer in the case was Ahmednasir Abdudulahi. Using a fake name ”Andrew Mwashigadi”, Mburu in 2014 wrote to EACC accusing Ahmednasir of using his influence within the judiciary to get a favourable ruling on the case.
Mburu went ahead to accuse then High Court judge Warsame (now judge of the Court of Appeal) who dealt with the matter, alleging that he was paid sh 50 million to grab the land from him. The EACC, after investigations, again found out that ‘Mwashigadi’ – who had not put his contacts on the complaint he made against Ahmednasir – was lying.
According to sources, Njoki Ndung’u, who is known within the judiciary as ”Mrs Moneybags” – her name recently featured in Justice Philip Tunoi bribery scam- is fighting to give the land to her old flame.
Njoki has two interests in the outcome of the case. The first, obviously, is to get back to Ahmednasir who just recently, in an opinion article, dismissed her contribution to the supreme court, referring to her as a ‘political appointee’.
The second interest is to have judge Warsame’s high court judgement on the matter overturned. Warsame is an esteemed judge seen as potentate to the Supreme Court. He sits in the JSC, which Jubilee is keen to control. He is among the JSC members who sent Njoki’s comrade-in-crime, Justice Philip Tunoi, to inflation, with his name muddied in the sewer of graft in an ongoing scam that has threatened to consume the whole of the Supreme Court.
Njoki, adversely named as one of the corrupt supreme court judges, has threatened to sue Businessman Jacob Juma.
A source told this writer the appeal court is set to decide on the matter in the coming days and Njoki is doing everything to sway their decision.
Governor Joho, on his part, has remained disengaged with the issue, which sources close to him say is a continuation of Jubilee government’s attempt to destroy his businesses for his refusal to support the regime.
