The DPP has ordered an immediate and speedy probe into Machakos Senator Johnson Muthama over remarks issued at a Busia rally on Monday.
Keriako Tobiko did not specify the “hate remarks” in his statement to newsrooms on Thursday.
But Muthama said during woman representative Florence Mutua’s homecoming that DP William Ruto should be investigated for remarks he termed offensive.
“We want an explanation of what ‘ kukaranga mtu ’ (to fry someone) means, if it is not hate speech. We might be forced to ‘fry’ him first before he does it to us,” he said.
Tobiko directed the National Cohesion and Integration Commission to look into the utterances that he termed offensive.
He said he reached the decision after reviewing a file on the matter from the Director of Criminal investigations. He said a report should be submitted to him for action.
The DCI recommended that Muthama be charged with the offence of ethnic contempt contrary to section 62 of the National Cohesion and Integration Act.
The Senator was among the eight MPs who were detained for three days at Pangani police station over hate speech allegations.
